Na temelju članka 50. stavka 1. točke 3. Zakona o zdravstvenoj ispravnosti i zdravstvenom nadzoru nad namirnicama i predmetima opće uporabe ("Narodne novine" broj 1/97 - pročišćeni tekst) ministar zdravstva donosi

PRAVILNIK

O IZMJENAMA PRAVILNIKA O KOLIČINAMA PESTICIDA, TOKSINA, MIKOTOKSINA, METALA I HISTAMINA I SLIČNIH TVARI KOJE SE MOGU NALAZITI U NAMIRNICAMA, TE O DRUGIM UVJETIMA U POGLEDU ZDRAVSTVENE ISPRAVNOSTI NAMIRNICA I PREDMETA OPĆE UPORABE

Članak 1.

U Pravilniku o količinama pesticida, toksina, mikotoksina, metala i histamina i sličnih tvari koje se mogu nalaziti u namirnicama, te o drugim uvjetima u pogledu zdravstvene ispravnosti namirnica i predmeta opće uporabe ("Narodne novine" broj 46/94) u članku 2. stavku 1. iza riječi: "kemijska" dodaju se riječi: "i mikrobiološka", a u točki 1. riječi; "nematoda, glodavaca i ptica" zamjenjuju se riječima: "nematoda i glodavaca".

U stavku 2. riječi: "produkti biorazgradnje pesticida" zamjenjuju se riječima: "njihovi škodljivi razgradni produkti".

Članak 2.

U članku 3. riječi: "količine pesticida koje one sadrže nisu veće od količina označenih u Tablici I - Dopuštene" zamjenjuju se riječima: "pesticida koje one sadrže nisu veće od količina označenih u Tablici 1 - Maksimalno dopuštene".

Članak 3.

U članku 5. riječi: "ukupnu masu (bez kostiju)" zamjenjuju se riječima: "jestivi dio".

Članak 4.

U članku 6. iza riječi: "do 5 puta veće količine pesticida od najviše dopuštenih" dodaju se riječi: "za voće i povrće".

Članak 5.

U članku 15. riječi: "Sirove ili poluprerađene namirnice koje" zamjenjuju se riječima: "Sirovine ili poluproizvodi koji".

Članak 6.

Članak 18. mijenja se i glasi:

"Za onečišćenja koja nisu regulirana ovim Pravilnikom, dopušta se količina koja nije veća od granice određivanja priznatom metodom."

Prema Ustavu Republike Hrvatske, a uzimajući u obzir jedno od glavnih načela prava ignorantia iuris nocet (s latinskog nepoznavanje prava šteti - nitko se ne može ispričavati da nije znao da nešto zakonom nije bilo zabranjeno ili regulirano), prije nego što stupe na snagu zakoni i svi drugi propisi državnih tijela obvezno se objavljuju u Narodnim novinama. Osim zakona i drugih akata Hrvatskog sabora, u Narodnim novinama objavljuju se uredbe i drugi akti Vlade Republike Hrvatske, pravilnici, naredbe, napuci koje donose nadležni ministri, presude Ustavnog suda Republike, imenovanja i razrješenja državnih dužnosnika, veleposlanika, te i svi drugi akti državnih institucija. Također u posebnom dijelu (Narodne novine - Međunarodni ugovori) objavljuju se međunarodni ugovori koje je sklopila Republika Hrvatska. U narodnim novinama nalazi se i oglasnik javne nabave.
